摘要大学生就业权是指法律规定或认可的大学生所享有的与就业有关的权利的总称。包括平等就业权、就业自主权、公平待遇权、违约求偿权等。然而当前,随着高校扩招工作的不断开展,我国大学毕业生的人数呈现出明显上升趋势,与此相对应的,大学生就业难成为社会各界关注的热点之一。面对劳动力市场供大于求的严峻形势,大学生就业过程中权益被侵犯的事件时有发生。大学生平等就业权的法律保护问题也引起了社会的广泛关注。12345
大学生就业具有时效性、政策性、复杂性等特点。目前,我国的《宪法》、《劳动法》、《劳动合同法》和《就业促进法》等法律法规中对劳动者合法权益作了明确规定,体现了保护劳动者权益的立法精神。然而目前在大学生就业过程中仍存在诸多法律问题,主要表现有:就业歧视、试用期的滥用、用人单位利用其主导地位制定“霸王条款”、用人单位设置就业陷阱等。究其原因主要有:劳动力市场供大于求矛盾尖锐、毕业生就业难处于弱势地位、一些用人单位缺乏社会责任感、高校就业指导力度不够等,除此之外,另一个重要原因是有关大学生就业权法律保护机制不健全:立法方面,大学生就业的法规和政策存在缺失,劳动法将大学生就业权保护排除在外等;执法方面,执法机构设置欠缺,执法力量不足,存在“选择性执法”现象等;权利救济方面,劳动争议受案范围狭窄,举证责任分配不合理,救济程序效率低、诉讼成本高,法律监督不到位等。因此应进一步加强对大学生就业权益的保障。第一,政府完善立法,强化监督管理,完善劳动争议解决机制;第二,政府、用人单位和大学生应进一步增强法制观念,提高法律意识;第三,高校应成立维权机构,加大就业指导工作力度。通过社会、高校和个人的共同努力,创造良好的就业环境,促进大学生顺利就业。

Title  Research on the legal protection of College Students’ Employment Rights
Abstract
University student’s employment right is the general terms of the right prescribed or authorized by the law that the university students should enjoy and is concerned with employment, including equal right to employment and free right to obtain employment opportunities, right to equal treatment ,and default ask for compensation power and so on. But at present, with the work of the college expansion develop continuously, the number of college graduates in our country present a clear ascendant trend. And the corresponding, college students' employment difficult to become one of the focus of the society from all walks of life. Facing the serious situation of the labor market supply, college students often encounter all kinds of behavior which aggrieve their Labor Rights. College students' equal right to employment law protection also caused extensive attention of the whole society.
   College students’ employment is timeliness, policy, complicated. Currently, labors’ lawful benefits is explicitly stipulated the Constitution, the Labor Legislation, Labor Contract Law and Employment Promotion Act, but now in the process of college students' employment still has a lot of legal problems. for instance: employment discrimination, abuse of the probation period, and some employers force college students accept “imparity clause” by making use of their superior position in labor relation, and the employing unit set employment trap and so on. The main reasons are: the Labor market supply sharp contradiction, graduates' employment at a disadvantage, some employers are lack of social responsibility, and universities employment instruction is inadequate, last but not least, the college students' right to employment law protection mechanism is not sound. Therefore we should strengthen the legal protection of university students’ employment right. Firstly, the government improves legislation, strengthen supervision and management, perfecting labor dispute resolution mechanism. Secondly, the government, the employer and college students should further enhance legal concepts, improve the legal consciousness. Thirdly, colleges and universities should be established rights organization, and increase the employment guidance work dynamics.
